Acceptable Use Policy

1. Scope

This Acceptable Use Policy ("AUP") applies to everyone who uses the Services provided by Midnight Mission Systems, including the Blue Collar Trade Manager platform and apps. It is incorporated into and part of our Terms of Service. Capitalized terms have the meaning given in the Terms.

2. Prohibited Conduct

You agree not to use the Services to:

• Violate any law, regulation, or third-party right.
• Engage in fraud, deception, money laundering, or financing of illegal activity.
• Process payments that you are not authorized to process, or facilitate transactions for others in a way that disguises the true source or purpose of funds.
• Send unsolicited or unlawful communications (spam), including SMS or email that violates applicable consent and anti-spam laws.
• Infringe intellectual property or misappropriate confidential information.
• Harass, threaten, defame, or harm others.
• Upload malware or interfere with the integrity or performance of the Services.

3. Prohibited and Restricted Businesses

Because BCTM relies on regulated payment partners, you may not use payment features for businesses or activities that our processors prohibit or restrict. These commonly include, without limitation:

• Illegal products or services, and anything that violates law where you or your customers operate.
• Fraudulent, deceptive, or unfair business practices.
• Regulated or prohibited categories such as illegal drugs and paraphernalia, weapons and munitions where prohibited, counterfeit goods, and unlawful gambling.
• Adult content and services where prohibited by our processors.
• Other categories listed as restricted or prohibited by our payment processors (for example, the Stripe Restricted Businesses list).

4. System and Network Security

You may not attempt to gain unauthorized access to any part of the Services, other accounts, or connected systems; probe or test vulnerabilities without authorization; circumvent authentication or rate limits; or engage in denial-of-service activity.

5. Content Standards

Content you create or send through the Services (including invoices and messages) must be accurate, lawful, and not misleading. You are responsible for obtaining any consents required to contact your customers by SMS or email.

6. Enforcement

We may investigate suspected violations and take action we deem appropriate, including removing content, limiting or suspending access, withholding or reversing payouts, reporting to authorities, and terminating accounts. We may act immediately where there is risk of harm, fraud, or legal exposure.
